Terms and conditions to comply with local regulations and adequately to the Trekking and Tours that operated by Touch The Himalaya Treks and Expedition Pvt. Ltd. Additionally, We consider tailoring these terms to reflect the unique aspects of our company and the services we offer.

Touch The Himalaya-Term and Conditions

Beyond its renowned trekking trails, Nepal’s rich tapestry of cultural heritage, including vibrant festivals, ancient temples, and diverse ethnic communities, adds depth and intrigue to every traveler’s journey. Whether exploring the medieval city of Kathmandu, embarking on a soul-stirring pilgrimage to sacred sites like Pashupatinath and Lumbini, or seeking serenity amidst the tranquil beauty of Pokhara’s lakes and mountains, Nepal invites visitors to immerse themselves in an unforgettable tapestry of adventure, spirituality, and natural splendor.

TERMS AND CONDITIONS FOR BOOKING AND PAYMENT

Before booking a trip (Tour or Trekking) with Touch The Himalaya, travelers must familiarize themselves with and consent to our company’s terms and conditions.

  • Reservation: To reserve a trekking or tour package, clients must make at least 10 to 15 % deposit of the total trip cost (depends what types of tour or trekking) . The remaining balance can be settle by the day before the trip start date. (To book some specific trips we organize, we require valid scanned copy of Passport and passport size photo)
  • Trip Details (Itinerary Changes)- We reserve the right to modify the itinerary due to unforeseen circumstances such as weather conditions, natural disasters, or political unrest. Alternative arrangements will be made to ensure the safety and enjoyment of the clients.
  • Fitness Requirement: Clients are responsible for ensuring they meet the physical fitness requirements specified for their chosen trekking or tour package. We are not liable for any injuries or health issues that arise due to insufficient fitness levels.
  • Travel Insurance: It is mostly recommended for all clients to obtain comprehensive travel insurance that covers trekking or touring activities, medical emergencies, trip cancellations, and evacuations. Proof of insurance may be requested prior to the trip start date. We prioritize the safety and well-being of our clients. Therefore, we require all participants to obtain comprehensive travel insurance that covers the mentioned aspects, in the page of “IMPORTANCE OF TRAVEL INSURANCE
  • Health and Safety: Clients must comply with all safety instructions provided by the guides during the trip. We are not liable for any injuries or accidents resulting from failure to adhere to safety guidelines.
  • Accommodation and Meals: If the Accommodation and meal arrangements are included as specified in the itinerary. Any additional expenses incurred by clients (e.g., extra meals, drinks, laundry) are their responsibility.
  • If the travelers commit any illegal activities on the trip, the representative of our company has the authority to ask you to leave the trip immediately without being refund.
  • If there is any compliant regarding the weakness of our company or our company representative then it should be brought to an attention of the company so that actions can be taken under such circumstances.
  • By receiving the 10-15% of the package amount of the trip, the required reservation flight, booking details and the required booking of the hotels and others are send through the mail; also confirmed.
  • Our company takes the responsibility of the protection of the data shared to our company such as passport details, bank account details and so on.
  • The expenditure during the trip  which are not included inside the package are need to be done by the travelers themselves.
  • Flight delay or cancellation may happen often due to the bad weather condition so we suggest our clients to carry the accommodation fees and foods themselves under such circumstances i.e. for the additional expenses Touch The Himalaya Treks & Expedition Pvt. Ltd. Will not be responsible.
  • If the travelers are need to leave the trip immediately due to some circumstances then the amount that has been paid to our company are not refundable or condition apply there.
  • The travelers are need to have legal passport and visa. The passport should have the validity of 6 months before arriving in Nepal and for the visa of Nepal, it will be issued under the arrival of the person in TIA (Tribhuvan International Airport). The expenses of visa are not responsible by our company.
  • During the Trip, keeping the personal stuffs are traveler’s responsibility however we do our best to keep our client’s personal stuffs safe.

Liability and Responsibility:

  • Assumption of Risk: Trekking and touring activities involve inherent risks, including but not limited to altitude sickness, injury, and loss of personal belongings. Clients participate in these activities at their own risk.
  • Limitation of Liability: We are not liable for any damages, losses, or injuries sustained by clients during the trip, except in cases of willful negligence by our company.
  • Travel Documentation: Clients are responsible for obtaining all necessary travel documents, including visas, permits, and passports, before the trip start date. We are not liable for any consequences resulting from inadequate documentation.

Miscellaneous:

  • Force Majeure: We are not liable for any delays, cancellations, or modifications to the trip itinerary caused by force majeure events beyond our control, including but not limited to natural disasters, strikes, or government regulations.
  • Client Conduct: We reserve the right to refuse service to any client whose conduct is deemed detrimental to the safety, enjoyment, or well-being of themselves or others.

Note: While transferring the amount in the bank account, the bank takes the service charge That must have to be paid by clients.
 
Risks
The tours are conducted within the validation of certain rules and regulations by the tourism board, if any changes have been done in such unavoidable circumstances, under political issues, delays and cancellation of flights, accidents and so on then we are not liable of it.
Note: Considering the circumstances we accept the last hour booking.

Postpone and cancellation of the trip

  • Cancellations made two weeks or more before the trip start date will receive a full refund minus any non-refundable expenses (e.g. permit fees, administrative costs, Hotel or flight cancellation fees etc.). Cancellations made within one weeks of the trip start date will not be eligible for a refund.
  • Under both circumstances an application should be sent before two week of the departure date of the trip.
  • If the clients want to postpone theirs  trip, Advance payment will be keep as it is  for theirs postponed date, however in case of cancellation of the trip certain amount (10%) will be charged and the other remaining amount of the trip booked amount will be refunded.
  • During the trip, if the travelers don’t want to go futher or they are unable to go further and they have to return back then no any refund will be provided but the transportation or safetly evacuation can be managed.

Ltd. is a well renowned governmental authorized company, all the programs we run through our company are under the act of government of Nepal.
 
Note: Touch The Himalaya Treks & Expedition Pvt. Ltd has the authority to update the terms and condition. It is the visitor’s duty to be updated on the terms and condition of our company.

Jurisdiction: These terms and conditions are governed by the laws of Nepal. Any disputes arising from these terms and conditions will be subject to the exclusive jurisdiction of the courts of Nepal.

By booking a trekking or tour package with Touch The Himalaya, clients acknowledge that they have read, understood, and agreed to these terms and conditions.
